Terms and conditions of sale

1. Introduction

1.1 The offer and sale of products on our website www.midorjhairjewels.it (hereinafter the Website) are governed by the following General Conditions of Sale (hereinafter the Conditions) which apply to anyone who visits or makes a purchase on the site.

1.2 The Conditions may undergo changes, it being understood that the applicable Conditions are those in force at the time the order is placed by the Customer.

1.3 Access to and use of this Site, as well as the purchase of products, presuppose the reading, knowledge and acceptance of these General Conditions of Sale.

1.4 The products purchased on this site are sold by Midori Design Architecture & Engineering Srl VAT number 02293500563, Via Cinque Fonti, 2 – 05022 Amelia (TR) – (hereinafter the Seller).

1.5 Anyone who browses the Site is the one and only responsible for the use of the Site and its contents. Viewing the Site, purchasing our products and being able to acquire information about them constitute an activity that each user carries out for personal and extraneous use for commercial purposes.

1.6 Each user is solely responsible in the event that the information and data provided are false, inaccurate or refer to third parties who have not given their consent.

1.7 The Seller is not responsible for any damage caused to the user by browsing the Site and the user assumes all risk in this regard.

1.8 The user is responsible for the custody and correct use of his personal data, including the credentials that allow access to reserved services, as well as for any harmful consequence or prejudice that may arise for the Seller or third parties as a result of the lack of correct use, loss, theft of such information.

2. Order

2.1 The purchase order (hereinafter the Order) must be made using the appropriate form available on the Site.

2.2 The Seller reserves the right not to accept purchase orders:

1. a) from countries not belonging to the European Community;
2. b) with a delivery address without a contact person, at hotels or post office boxes;
3. c) in the event that it is not possible to reach the user who placed the Order;
4. d) in case of doubt about the validity of the Order.

2.3. After placing the Order, Midori Hair Jewels via the Woocommerce platform will send the Customer an order confirmation email. Subsequently, by e-mail, he will inform the customer of the shipment of the products by courier with relative tracking.

2.4. When you buy with Paypal you will receive your order immediately and pay the total amount or in 3 installments. You acknowledge that your installments will be transferred by Paypal or related parties and their assigns, and that you authorize this transfer.

3. Price

3.1 The prices indicated on the site are expressed in Euros, inclusive of Italian taxes (European VAT and other applicable taxes). Packing, packaging and transport costs are included in the final price.

3.2. No customs duties are applied for deliveries within the European Community; outside the European Community, customs fees are charged to the customer.

3.3. The seller reserves the right to change prices at any time. Products already ordered will be invoiced on the basis of the prices in effect at the time of receipt of the Order.

4. Warranty and Liability

4.1. The jewelery products are made of bronze or silver, with the use of colored epoxy resins, as indicated in the relative technical data sheets. Their processing takes place in an artisanal way through an entirely manual process that guarantees their authenticity. Depending on the pH of your skin, these metals could cause skin discoloration. Any imperfections or alterations express the value and uniqueness of each piece. All the jewels made are nickel free.

4.2 All products are covered by the two-year legal guarantee of conformity.

4.3 Defective products that the customer returns during the two-year warranty period will be replaced or repaired by the Seller, any form of reimbursement or compensation being expressly excluded.

4.4 The guarantee is recognized under the following conditions:

– the customer has notified the Seller via e-mail of the return of the defective products;

– the defect is not due to anomalous or non-compliant use, an accident or an external cause (such as intervention on the product by unauthorized persons)

– the defect is not due to wear or normal aging.

4.5 The shipping and return costs of the products remain entirely the responsibility of the customer.

4.6. The Seller declines all responsibility in the event that the delivered products do not comply with the legislation of the non-European Union country in which they are eventually delivered.

4.7. The Seller undertakes to pay due attention to this work to ensure the service offered to the customer. However, the Seller is in no way responsible for failure to comply with contractual obligations due to unforeseeable circumstances or force majeure, as required by Italian law.

Furthermore, in the event of non-substantial differences between the photographs presenting the products on the Site, the texts, illustrations and the products ordered, the Seller is not responsible in any way.

4.8. The Seller is not liable in any case for loss of profits, commercial losses, loss of information, loss of earnings or any other indirect or unforeseeable damage at the time of using the Site or concluding the sales contract with the customer.

5. Payment

5.1. For the payment of the price of the products, the use of the PayPal method, credit card or bank transfer is required, as indicated in the purchase form. All payments must be made in Euro currency.

5.2 .The data provided to make the payment will be used by the Seller only and exclusively to complete the procedures relating to the purchase and to issue the relative refunds in the event of any return of the products. The debit of the purchase price of the products, as indicated in the purchase form, will be made to the customer’s current account at the time of purchase of the products.

6. Retention of title

The purchased products remain the property of the Seller until delivery to the carrier.

7. Availability and delivery of products

7.1 The purchased products will be delivered to the address indicated in the Order, together with the relative invoice, within 21 days of sending the Order confirmation referred to in the previous art. 2.3 or in the case of a product available only on order, this will be delivered in the various times specifically indicated in the Order Confirmation.

7.2. In case of payment by bank transfer, the delivery term will start from the moment the price is credited.

7.3. The terms indicated in the previous art. 5.2 must be considered indicative. In the event of a delay, the Seller will contact the customer by email or telephone as soon as this information is available.

7.4. If, despite acceptance of the Order, a product is not available or cannot be delivered, the Seller will promptly inform the customer via e-mail and the Order will be cancelled.

In this case, the customer will only be entitled to a refund of the price paid, any other form of compensation being expressly excluded.

9. Right of withdrawal

9.1 Purchases made on the Site are governed by Legislative Decree 185 of 22 May 1999. The customer can withdraw from the contract by written notice by registered mail with return receipt to be sent to Midori Architecture Design & Engineering Srl , Via Cinque Fonti, 2, 05022 Amelia (TR) within 14 working days from receipt of the products.

The communication can also be made by certified mail to the address midorjewels@pec.it provided that it is confirmed with acknowledgment of receipt within the following 48 hours. In any case, we advise the customer to contact us on +39 3458183718 to facilitate the refund procedure which will take place via bank transfer or paypal once the return has been received, which must be in the same condition in which it was sent

9.2. Shipping costs will be charged to the customer.

9.3. The right of withdrawal – in addition to compliance with the terms and methods described in the previous articles – is understood to be exercised correctly if the following conditions are also fully respected:

• – the products must not have been used or damaged;
• – the products must be returned in their original packaging, together with the relative invoice.

• – the products must keep intact the accompanying guarantee seal which certifies their non-use

9.4. In the event that the products for which the right of withdrawal has been exercised are damaged or have suffered a decrease in value due to the use that has been made of them, the Seller reserves the right to deny the right of withdrawal or to charge the customer as compensation.

10. Refund times and methods in case of exercise of the right of withdrawal

10.1. After returning the products, the Seller will check that the products have not been damaged or tampered with. In the event that the checks are concluded positively, the Seller will send the customer, by e-mail, the relative confirmation of acceptance of the returned products.

10.2. The reimbursement of the price paid will be made by the Seller in the shortest possible time and in any case within fourteen (14) days from the date of confirmation of acceptance of the returned products via paypal or bank transfer.

10.3. If there is no correspondence between the recipient of the products indicated in the order form and whoever paid the sums due for their purchase, the refund of the sums, in the event of exercising the right of withdrawal, will be made to whoever made the payment.

11. Access to the Site and ownership rights

11.1. The Seller grants access to the Site and its use by the customer exclusively for personal use by the customer.

11.2. The contents of the Site are protected by copyright and by any other industrial and intellectual property right of the Seller and other rights holders. The Midori Hair Jewels brand and logo, as well as the domain www.midorjhairjewels.it are registered.

11.3. The customer is never authorized to download, reproduce, copy, sell, exploit or modify part or all of the Site (in particular the products listed, descriptions, prices, download or copy information, use the data, programs, audio contents, graphics, images, texts, photographs, tools) without the express written authorization of the Seller.

11.4. The Site may contain links to other Internet sites. These sites are not, under any circumstances, under the control of the Seller who is not responsible for the accuracy, compliance with intellectual property rights, legality, decorum or any other aspect of the content of these sites.

12. Protection of personal data

12.1. The Seller undertakes to protect the Customer’s personal data. All personal data concerning the customer and which the Seller has collected are treated in a strictly confidential manner, in accordance with the current provisions of the privacy law.

12.2. The personal data of the customer collected by the Seller from the products that the customer chooses, serve exclusively to fulfill the customer’s order in the best possible conditions and serve to offer the customer suitable offers

12.3. The customer’s personal data is never rented, transferred or sold to third parties for purposes other than the satisfaction of the customer’s order

12.4. The customer has the right to access and modify all personal information through the secure interface for managing his personal account

12.5. The non-personal data collected by the Seller from users’ browsing on the Site are used to improve the service offered to customers, in particular the ergonomics of the site, the products presented and the relationship with the customer.

13. Governing Law and Dispute Resolution

These Conditions are governed by Italian law and any dispute that may arise regarding the use of the Site and/or the purchase of products will be devolved to the exclusive jurisdiction of the Court of Terni.
